Tuesday, February 24, 2009
The City of Ball Ground Zoning Board of Appeals held a public hearing on Tuesday, February 24, 2009 at the Ball Ground City Hall.
Board Members Present: Chairman David Kubala, Scott Barnes, Sandy Klaesius, Daniel Sisson
Board Member Judson Roberts was absent.
Staff in Attendance: City Planner Michael Chapman, City Admin. Eric Wilmarth, City Attorney Darrell Caudill and City Clerk Karen L. Jordan
Item 1: Chairman David Kubala called the meeting to order.
Item 2: Pledge of Allegiance led by City Clerk Karen Jordan
Item 3: Old Business – None
Item 4: New Business
a) Elect Chairman – Motion by Board Member Barnes, Seconded by Board Member Sisson to appoint David Kubala as Chairman.
Motion Unanimously Approved
b) Adopt Roberts Rule of Order – Motion by Board Member Sisson, Seconded by Board Member Barnes to conducts meetings in accordance with the Roberts Rule of Order.
Motion Unanimously Approved.
c) Adopt Public Comment Policy – No action taken.
d) Case #2009-V102 W. S. Lathem Properties, LLC is requesting a variance to the Ball Ground Comprehensive Development Code Division 104.2 R-20, Single Family Residential (F) Area, Yard and Height Regulations and Division 113.3 Density; Reference Table 113-1: Conservation Neighborhood Density and Lot Size Requirements and Table 113-2: Conservation Neighborhood Setback Requirements. The property is located at 116 Covington Drive in the Olde Mill Subdivision, Ball Ground, Georgia 30107 and further described as Cherokee County Tax Map No. 03N01A Parcel 020.
Chairman Kubala presented case.
Scott Lathem represented Case #2009-V102.
Don Kline, 114 Covington Dr., Ball Ground, Ga. 30107 spoke in opposition of the case on behalf of the residents of the Olde Mill Subdivision.
City Administrator Wilmarth stated to Board Members his reasons as Administrator for denying Mr. Lathem’s request.
City Attorney Darrell Caudill addressed Board Members.
Chairman Kubala closed public comment.
Board Member Scott Barnes made motion to deny the request, Seconded by Board Member Daniel Sisson. (See Attached Order for denial)
Motion Unanimously Approved.
e) Case #2009-V101 Larry Nix is requesting a variance to the Ball Ground Comprehensive
Development Code Division 104.11 (d) Permitted Use. The applicant is proposing to establish a used car sales business at 2945 Canton Hwy.. Ball Ground, Ga. 30107 and further described as Cherokee County Tax Map 94N02 Parcel 063.
Chairman Kubala presented case.
Mr. Larry Nix represented Case #2009-V101.
No one spoke in opposition of the case.
Chairman Kubala closed public comment.
Board Member Daniel Sisson put forth a motion, Seconded by Chairman David Kubala to approve the permitted use variance request.
Motion Approved 4 Yeas 1 Nay.
Item 5: Adjourn – Meeting adjourned at 6:50 P.M.
