Regular Meeting of the Mayor and Council

Item 1:        Meeting Called to Order -Due to the absence of Mayor Roberts the meeting was called to order by     Mayor Pro Tem Frank Homiller

Council Members Byrd, Holcomb, Prettyman and Stoner were present.

Staff Present:  Chief Dana Davis, Attorney Darrell Caudill, Finance Director             Randy Westbrook, City Adm. Eric Wilmarth, City Clerk Karen Jordan &             Doreen Hobbs

Wyatt Holcomb spoke in opposition to the proposed revised TND Ordinance.

Item 4:        Announcements/Informational Items/Project Updates

a)            Announcements – City Adm. Wilmarth
May 19 & 20:    Heritage Days Festival
May 28th    City Hall Closed for Memorial Day

b)        Project Updates                City Manager Wilmarth
1.  Downtown Streetscapes
Fifteen of the twenty-two easements needed to begin the project have been             acquired.  The remaining easements involve four property owners.  If those             owners have not signed on or before May 31, 2007 condemnation will be             considered.

2.  City Hall Project
W.H. Bass has delivered the construction trailer on site.  Construction crews             should be on site in approximately two weeks.

3.  Valley Street Project
Negations to acquire right of way for the Valley St. project are ongoing with the             Fox Family.

4.    Emory and Garrett Search for ground water
Emory and Garrett have completed onsite analysis of several sites believed to be possible well sites.  The data will be entered into computer models to pinpoint drilling locations.  Exact locations are expected to be announced the first week of June.

Item 5:        Approval of Minutes
a)            April 12, 2007 Regular Meeting Minutes
Council Member Stoner moved to approve the minutes as submitted by the city             clerk.  Council Member Holcomb seconded the motion.  Motion carried 4-0.

b)            April 26, 2007 Work Session Minutes
Council Member Stoner moved to approve the minutes as submitted by the city             clerk.  Council Member Holcomb seconded the motion.  Motion carried 4-0.
Item 6:        Consent Agenda

Council Member Stoner moved to approve the Consent Agenda items “b”             through “e” with the exception of item “a”.  Council Member Holcomb                 seconded the motion.  Motion carried 4-0.

a)    1st Reading – Revised TND Ordinance
b)    1st Reading – R-2007-02 FY 2008 Budget
c)    Approval of Lew Oliver, Inc Proposal
d)    2nd Reading Annexation Petition # 2006-12-07 James Philip Thomason, Applicant.  Request annexation of 2.53 Acres.  The property is located at 207 Ball Ground Road and further described as Cherokee County Tax Map 03N07, Parcel 46
e)    2nd Reading Annexation Petition #2006-12-08 James Philip Thomason, Applicant.  Request annexation of 22.92 Acres.  The property is located at 570 Gilmer Ferry Road and further described as Cherokee County Tax Map 03N07, Parcel 48.

Item 7:        Old Business
1)        Case #07-02-004 Sylvia W. Roberts & Blue Mule, LLC and James Phillip             Thomason requesting rezone 48.15+/-acres from R-40 & AG to TND.  If rezoned             the property would be utilized for a mix use community.  The property is located             at 207, 241, 309, 331 Ball Ground Road and 270 Gilmer Ferry Road and further             described as Cherokee County Tax Map 03N07, Parcel(s) 43A, 43B, 43C, 43, 46            and 48.

Council Member Stoner moved to approve the TND Zoning with the following             condition: Final Site Plan must be submitted to Council Members for approval.
Council Member Holcomb seconded the motion.  Motion Carried 4-0.

Item 9:        New Business
1)        Accept Valley Street from Coy M. Holcomb Street to Howell Bridge Road East.
Motion by Council Member Stoner, Seconded by Council Member Prettyman to             table this item of business.  Motion carried 4-0
2)        Accept Howell Bridge Road East beginning a the Railroad Crossing to     connection with Howell Bridge Road
Motion by Council Member Stoner, Seconded by Council Member Prettyman to             table this item of business.  Motion carried 4-0.
3)        Parking lot expansion and Paving at the Masonic Lodge.
City Administrator Wilmarth explained why the city should approve payment for             the parking lot expansion and paving.  He stated the parking lot serves as public             parking for the Lions Baseball Field as well as other city events.  In addition to             the fact that the Masonic Lodge donated the required easement for right of way             needed for the streetscape project.  The estimated cost to pave the parking lot is             $4,335.00.

Council Member Byrd moved to approve the bid of $4.335.00 for the cost the             parking area.  Council Member Stoner seconded the motion.  Motion carried 4-0.

Item 10:    City Manager Comments
Finance – Finance Director Randy Westbrook presented a statement of revenue             and expenditures and account balances for Mayor and Council review.  Total             account balances for period ended April 30, 2007 was $1,250,952.06.

Water & Sewage Dept. – A monthly report of gallons pumped and loss rate was             given.

June 25, 2007 has been set as start day to begin replacement of the old water             meters with the radio read system.
